Unitec Contract of Enrolment Terms and Conditions: International Applicants
Below are Unitec’s terms and conditions from 1 July 2019. Please read this document before you submit your application to enrol at Unitec.
You agree to the following terms and conditions when you submit an application to enrol on the Unitec enrolment portal:
1. Process for enrolling at Unitec
I understand that there are a number of steps that I must complete before I will be enrolled as a Unitec student. I understand that:
1.1. I will not be able to study at Unitec until I am enrolled as a Unitec student;
1.2. I will only be enrolled as a Unitec student when I have:
(a) Application: submitted a fully completed application for enrolment on the Unitec enrolment portal; and
(b) Conditional Offer: received a conditional offer from Unitec. This offer will set out what further information I need to provide to enrol in Unitec; and
(c) Acceptance: accepted the conditional offer; and
(d) Admission Criteria: provided the additional information that Unitec has asked for; and
(e) Unconditional Offer: received an offer of place from Unitec; and
(f) Payment: made full payment of my fees and other identified expenses to Unitec in the manner set out in the offer of place; and
(g) Confirmation: received written confirmation of enrolment from Unitec.
2. What is included in my Contract of Enrolment?
My contract of enrolment includes:
2.1. these terms and conditions; and
2.2. Unitec’s policies and procedures and
2.3. any further terms and conditions included in my offer of place and in any written confirmation of enrolment issued to me by Unitec.
My contract of enrolment is subject to the laws of New Zealand and Unitec and I submit to the exclusive jurisdiction of the New Zealand Courts in all matters arising from my contract of enrolment.
3. Course Selection and Programme Changes
3.1. Course selection: I have reviewed the information about the programme I am applying to enrol in. I understand that some courses in the programme are compulsory so that I can meet the academic requirements of the programme. I will enrol in all compulsory courses.
3.2. I understand that some courses are elective. Because there are only a certain number of places available in elective courses, Unitec may not be able to enrol me in an elective course where:
(a) places are limited and oversubscribed and I am not selected; or
(b) sufficient numbers have not subscribed for the course and it is not cost effective for Unitec to continue to offer it; or
(c) Unitec is not satisfied that I have made sufficient progress in the programme to enrol in the course.
3.3. I understand that programme regulations, the selection of courses and course content may change even after I have accepted my offer of place or after I receive a confirmation of enrolment.
4. Time Limits on Completion of Programme
I agree to use my best efforts to complete the programme I am enrolled in within the time limit set by Unitec.
5. Unitec Student’s Rights
5.1. Code of Practice: I am aware that under New Zealand law, Unitec has responsibilities for international students. These are set out in the Education (Pastoral Care of International Students) Code of Practice.
5.2. DRS: I am aware that there is an International Student Complaint Dispute Resolution Scheme (DRS) which was set up to help me resolve any financial or contractual disputes that I may have, as an international student, with Unitec.
5.3. I have been referred to Unitec’s most recent evaluation results by an education quality assurance agency.
5.4. Refunds: If I decide not to study at Unitec after I have been enrolled then I have the right to a refund if I inform Unitec of this before my semester start date. My entitlement to a refund will be determined in accordance with Unitec’s Fees and Refunds Procedures.
6. Unitec Student Obligations
6.1. Fees: I will pay all amounts owing to Unitec by the due date for payment. If I do not pay my fees, Unitec can recover the amount from me and I will have to pay for the costs of recovery.
6.2. Study Visa: I understand that my Offer of Admission will be subject to me having an appropriate study visa that enables me to live and study in New Zealand. I am responsible for complying with all conditions relating to my study visa. Unitec has the right to withdraw enrolment or decline to re-enrol me if I do not produce evidence of a valid study visa within the timeframe set out in my Unconditional Offer.
6.3. Insurance: I understand that under the Code I must have appropriate health and travel insurance in place from the time that I travel to New Zealand until I depart New Zealand. More information on insurance will be provided with my Unconditional Offer of a place at Unitec.
6.4. Policy Compliance: I agree to comply with Unitec’s rules which I can read on Unitec’s Policies page. In particular, I agree:
(a) Student Disciplinary Statute: not to engage in ‘prohibited conduct’ when I am on Unitec’s premises, or during any Unitec activity or service (including any field trip or placement as part of my Unitec course of study) or in in any situation that relates to me being a Unitec student.
What is prohibited conduct?
The meaning of “prohibited conduct” is set out in appendix 1 to Unitec’s Student Disciplinary Statute. If there is an allegation of prohibited conduct against me, Unitec will investigate in accordance with the Student Disciplinary Statute. If a decision is made that I have engaged in prohibited conduct, then Unitec is entitled to take disciplinary action against me.
The meaning of “prohibited conduct” is set out in appendix 1 to Unitec’s Student Disciplinary Statute. If there is an allegation of prohibited conduct against me, Unitec will investigate in accordance with the Student Disciplinary Statute. If a decision is made that I have engaged in prohibited conduct, then Unitec is entitled to take disciplinary action against me.
What disciplinary action can Unitec take?
The type of disciplinary action Unitec can take will depend on whether I have engaged in “inappropriate conduct”, “misconduct” or “serious misconduct” (all of these terms are defined in the Student Disciplinary Statute). The disciplinary action may range from a formal written warning for inappropriate conduct to expulsion from enrolment for serious misconduct.
The type of disciplinary action Unitec can take will depend on whether I have engaged in “inappropriate conduct”, “misconduct” or “serious misconduct” (all of these terms are defined in the Student Disciplinary Statute). The disciplinary action may range from a formal written warning for inappropriate conduct to expulsion from enrolment for serious misconduct.
(b) Internet Use: When I use the internet at Unitec I will comply with Unitec’s Electronic Devices and Systems Policy. If I do not, I am aware that I may face costs and consequences including termination of my access. View Unitec’s Electronic Devices and Systems Policy.
(c) Computer login details: I will not give my computer login details to anyone else. I know that if someone else uses my login details, then I am responsible for what they do when they are using my login. I will contact Unitec if I think someone else has my computer login details.
(d) Privacy: I agree that Unitec can hold information about me and I can access and correct that information if I choose. Read Unitec’s Privacy Procedures Document. I agree that the personal information I have given Unitec may be shared with and validated by other organisations, and shared within Unitec. Other organisations include: government ministries, departments and agencies, and industry training organisations, registration bodies, other tertiary institutes, previous secondary schools, students’ associations at Unitec and providers of work experience. My information will be shared if it is relevant to my enrolment and progression as a student and graduate of Unitec, but might also be shared so that Unitec can comply with its obligations to government departments and agencies such as the Police, ACC, TEC, NZQA and immigration authorities.
(e) Updates: From time to time Unitec may send me information about other courses, programmes, or services that may be useful to me.
Enrolment Application Declaration
I declare that:
1. I have read the information about the programme that I am applying to enrol in and I understand the qualification that I will receive if I successfully complete it.
2. I am solely responsible for ensuring that any offer I accept is for a programme that I am eligible to study and wish to study.
3. I authorise Unitec to collect, hold, use and disclose my personal information in accordance with the terms and conditions and with Unitec’s Privacy Policy and Privacy Procedure.
4. The information given in my enrolment application is true and correct and I have not withheld any information that may have a bearing on Unitec’s decision to enrol me.
5. In submitting my enrolment application, I have read, understood and agree to the terms and conditions of this contract of enrolment.
6. I confirm that the evidence of identity and citizenship I have supplied is correct and belongs to me.
7. I have been referred to the Fees and Refunds Procedures for information on International Student Refunds.
8. I have been referred to the disciplinary process provided for in the Student Disciplinary Statute and I understand that a breach of this Statute may lead to disciplinary action against me.
9. I understand Unitec has responsibilities towards me as an International Student and I have been referred to the Code and the DRS.
10. I understand that Unitec reserves the right, at its sole discretion (but acting reasonably) to cancel or delay any programme, or change the schedule of any course that it offers.
